When the Judicial Understaffing Delays Getting Emergencies Solved (JUDGES) Act passed the Senate last August, it passed unanimously. The bill would create over 60 federal court seats over the next decade in an effort to decrease caseloads in jurisdictions with high volumes, particularly in California and Texas. Trump would be able to fill 11 of those seats in 2025 and 11 more in 2027. MAGA Mike had refused to bring the vote up until after the election in order to be sure which party’s candidate would be able to fill the seats.
So now the Democrats are no longer enthusiastic about seeing it enacted. In fact, before the House voted on it Thursday, Biden said he would veto it if it passed. Biden had warned that “While judicial staffing is important to the rule of law, S. 4199 is unnecessary to the efficient and effective administration of justice. The bill would create new judgeships in states where Senators have sought to hold open existing judicial vacancies. Those efforts to hold open vacancies suggest that concerns about judicial economy and caseload are not the true motivating force behind passage of this bill now. In addition, neither the House nor the Senate fully explored how the work of senior status judges and magistrate judges affects the need for new judgeships. Further, the Senate passed this bill in August, but the House refused to take it up until after the election. Hastily adding judges with just a few weeks left in the 118th Congress would fail to resolve key questions in the legislation, especially regarding how the judges are allocated.”
On Thursday, 207 Republicans and 29 Democraps, including third-in-command Pete Aguilar, voted for the bill, while 171 Democrats and 2 Republicans (contrarians Chip Roy and Tim Burchett) voted no. These are the 29 Democrats who voted to give Trump the opportunity to appoint 22 more judges as corrupt, partisan and incompetent as Aileen Cannon:
